Checbox (NaviFacet) PRIVACY POLICY 

This Privacy Policy describes how Checbox (“Checbox,” “we,” “us,” or “our”), operated in the United States by Navifacet LLC (a Maryland limited liability company), collects, uses, discloses, and protects your personal information when you use our website, mobile applications, and related services (collectively, the “Service”). 

This Policy is intended to comply with applicable U.S. federal and state privacy laws, including but not limited to: the Federal Trade Commission Act (FTC Act, 15 U.S.C. § 45), the Children’s Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.), the CAN-SPAM Act (15 U.S.C. § 7701 et seq.), the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Virginia Consumer Data Protection Act (VCDPA), the Colorado Privacy Act (CPA), and other applicable state privacy statutes. 

By accessing or using our Service, you agree to the collection and use of your information as described in this Privacy Policy.

2. Personal Information We Collect

  • Geolocation data: Precise and approximate location data, including background location when permitted;

  • Usage and diagnostic data: App usage patterns, log data, clickstream data, and diagnostic reports; 
  • User-generated content: Images, files, and other content you upload or capture through the application when permissions are granted. 

We do not collect Social Security numbers, financial account numbers, or other sensitive government-issued identifiers unless expressly required and disclosed for a specific service feature.

  • Service Providers: Third-party vendors and contractors who perform services on our behalf (e.g., cloud hosting, analytics, payment processing, customer support) under written agreements that restrict their use of your data; 
  • Affiliated Entities: Affiliates and related entities involved in delivering the Service, including Monico Technologies Ltd.; 
  • Legal and Regulatory Authorities: Government agencies, law enforcement, courts, or regulators as required by applicable law or legal process, including in response to lawful subpoenas, court orders, or government demands; 
  • Business Transfers: Buyers, successors, or assignees in the event of a merger, acquisition, restructuring, or sale of assets, provided the acquiring party is bound to use personal information consistent with this Policy; 
  • With Your Consent: To other parties with your prior explicit consent. 

We do not sell your personal information to third parties for monetary or other valuable consideration, as defined under applicable state privacy laws including the CCPA/CPRA. We do not share personal information for cross-context behavioral advertising without offering an opt-out as required by law. 

6. Cross-Border Data Transfers 

As Checbox operates with affiliated entities and service providers globally, your personal information may be transferred to, stored, or processed outside the United States. We ensure that any such international transfers are conducted under appropriate legal safeguards, such as Standard Contractual Clauses approved by relevant authorities, data processing agreements, or other mechanisms that provide a level of protection consistent with applicable U.S. law. 

7. Cookies and Tracking Technologies 

We use cookies, web beacons, and similar tracking technologies to: 

  • Maintain session state, authentication, and security; 
  • Analyze website traffic and user behavior for performance improvement; 
  • Remember user preferences and settings. 

You may manage your cookie preferences through your browser settings or, where applicable, through our cookie consent tool. Please note that disabling certain cookies may affect the functionality of the Service. 

We honor “Do Not Track” signals to the extent required by applicable state law. Where required (e.g., California, Colorado), we provide a mechanism to opt out of the sale or sharing of personal information collected via cookies.

We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, to maintain our business relationship with you, or as required or permitted by applicable law. When personal information is no longer required, we will delete or de-identify it in accordance with our data retention procedures. Usage and analytics data may be retained in aggregated or anonymized form for longer periods for internal analysis and service improvement.

Depending on your state of residence, you may have the following rights with respect to your personal information, subject to applicable exceptions under law:

  • Right to Correction: The right to request correction of inaccurate personal information;

We will respond to verified requests within the timeframes required by applicable law (e.g., 45 days under the CCPA/CPRA, extendable by an additional 45 days with notice). We will not charge a fee for processing your request unless it is manifestly unfounded or excessive. 

11. California Residents — Additional Disclosures (CCPA/CPRA) 

If you are a California resident, the following additional disclosures apply in accordance with the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, “CCPA/CPRA”): 

Categories of Personal Information Collected in the Past 12 Months: Identifiers, commercial information, geolocation data, Internet and network activity information, and professional/employment-related information. 

Business Purposes for Collection: As described in Section 4 above. 

Categories of Third Parties with Whom Personal Information Is Shared: As described in Section 5 above. 

Do Not Sell or Share My Personal Information: California residents may opt out of the sale or sharing of their personal information by contacting us at support@checbox.com or by using our opt-out mechanism available on our website. We do not knowingly sell or share the personal information of individuals under 16 years of age. 

Shine the Light: California Civil Code Section 1798.83 also permits California residents who are our customers to request certain information about whether we disclose personal information to third parties for their direct marketing purposes. To make such a request, please contact us as specified above. 

12. Data Breach Notification 

In the event of a data breach involving your personal information, we will notify affected individuals and applicable regulatory authorities as required by applicable U.S. state data breach notification laws. Most U.S. states require notification “in the most expedient time possible” or within a specified timeframe (e.g., 30, 45, or 60 days, depending on the state) following discovery of the breach. 

Notifications will be provided via the contact information we have on file for you and/or through our website and application as required by law. 

13. Children’s Privacy (COPPA Compliance) 

Our Service is not directed to children under the age of 13, consistent with the requirements of the Children’s Online Privacy Protection Act (COPPA, 15 U.S.C. § 6501 et seq.). We do not knowingly collect, use, or disclose personal information from children under 13 without verifiable parental consent. 

If we become aware that we have inadvertently collected personal information from a child under the age of 13 without parental consent, we will take prompt steps to delete such information from our records. If you believe we have collected information from a child under 13, please contact us immediately at support@checbox.com. 

14. Email Marketing — CAN-SPAM Compliance 

If you receive marketing emails from us, each such email will comply with the CAN-SPAM Act (15 U.S.C. § 7701 et seq.) by clearly identifying the message as an advertisement, including our physical mailing address, and providing a clear and conspicuous mechanism to opt out of future marketing emails. We will honor opt-out requests within 10 business days. 

15. Third-Party Links 

Our website and Service may contain links to third-party websites, products, or services. We are not responsible for the privacy practices or content of such third parties. We encourage you to review the privacy policies of any third-party sites you visit before providing them with personal information. 

16. Changes to This Privacy Policy 

We may update this Privacy Policy from time to time to reflect changes in our practices, applicable law, or for other operational or legal reasons. When we make material changes, we will revise the “Last Updated” date at the top of this Policy and provide notice through our website or application, and by email where required by applicable law. 

Your continued use of the Service following the effective date of any updated Privacy Policy constitutes your acceptance of the revised terms.
